Obviously, it's a question of law; which few of us are qualified to give answers to. But, after taking a look at the samples page at BreakYourNonCompete.com, they lead me to believe that if you are laid off, a non-compete would not apply. Since you are trying to pre-empt a layoff, the employer would probably have to prove that you would not have been laid off.
