When is this considered a criminal act?
Intentionally sabotaging someone else's computer system is a federal
crime, and may also be against the law in the state where the computer
resides.
When can one expect to retrieve damages in a civil suit?
Ha! Just because the former employee did something wrong, and you can
prove it, does not mean that you can 'recover' damages. An employee
with a net worth under $100K could easily do millions in damages. The
legal system is not going to make you whole. You're better off spending
the time and effort on preventive measures rather than trying to put
Humpty back together again after the fall.
