If you suspect sabotage, unauthorized access to the systems after an
employee has been terminated, you need to document the details immediately
and notify your local law enforcement agencies.
Recovering damages in a civil suit are almost impossible, due to the fact
that the former employee can always file for BK and thereby avoid and civil
damages; this however does not exclude any criminal court mandated
reimbursements or fines.
You can place an ad anytime you want for personnel reasons and no employee
has any right to damages for you looking for a replacement; just make sure
that when you do terminate you have grounds for doing so (state laws vary on
this).
