>No, CGIDEV2 is copyrighted by IBM. I've not read the license on CGIDEV2, but copyright ownership does not prevent open source in general. There's nothing to prevent IBM from retaining the copyright and still releasing the code under GPL or BSD. I think GPL would make sense as they could then easily extend the original code and charge for it if they wanted to, but no one else could use the released code and charge for it.
