That code is specifically distributed under the terms of the BSD license, which specifcally says that the copyright notice, etc, must be included. I'm not a lawyer, and I'm not qualified to give you legal advice. However, I work with BSD licensed software regularly, and I've always taken it at face value. Read the legal info at the top, it's pretty clear what they want you to do if you distribute it. Sorry if this offended you. I just don't want David, you, or this list to get into trouble for distributing it illegally.
