It is the former where I have seen the problem in the generated code, but I
wouldn't be surprised to find that CLLE does exactly the same kind of thing.
As to applicability,  CL only passes parameters by reference, and it would
definitely fail if passed by value anyway, so passing a parameter (on the
surface) in CL works the same way regardless of whether it is a bound call
or not.  I'd be very loathe to rely on something that works on a bound call
but fails when used on a dynamic call.
