If a programmer was told to shoot someone and did is he guilty of murder? Yes. Same goes with your question. If the programmer was told to write code to remove 5 cents from all employees pay checks and did so that person is guilty of a crime. My wife is a nurse and even if a doctor tells her in writing to give a certain dose of medication that she's knows is wrong and she does it, she is just as liable as the doctor who ordered it.

I would hope you are correct but, I do not know for certain. If a
programmer is directed to write code that violates the law and the code
is discovered is the programmer culpable? I suspect the courts would

There is a fiduciary responsibility associated with various
professionals. If your company is doing stuff that you think is
illegal, you first have an obligation to bring this to the attention
of management. If management does not take action that you feel is
