Perhaps. But they couldn't call it MySQL. That's a trademarked name (and
Logo) of MySQL AB, which is owned by Sun. And the logo usage rights
specifically say that MySQL can revoke the usage rights "at any time in
its sole discretion." So at best you could distribute "The database
formerly known as MySQL", and even that would probably get the Oracle
lawyers on your case.

As I mentioned earlier, this is a great way to alienate many, if not most, current MySQL users. Secondly, MySQL is popular enough that the new project probably wouldn't need to worry much about marketing. I don't think this is likely to happen,
