In a former life (before I started in IT), I worked at a patent & 
trademark agent's office.

The same TM/SM can be registered for any product or service you choose, as 
long as it doesn't conflict with an existing one for the same or similar 
product/service.

So if you made a gizmoid for use by a transportation company, you still 
might have problems registering "Brown" for it.

It's not so much that UPS "owns" the sm/tm to "Brown", it's a contextual
thing in terms of how they use it for business.

Ie, in this case, you can't use Brown in the context of a transportation
company, but if I were to call some new gizmoid that I just made "Brown"
and market it thusly, I could tm/sm that contextual useage.  It's all in
how it's used in business...so much for my knowledge of IP law... :)
