In a former life (before I started in IT), I worked at a patent & trademark agent's office. The same TM/SM can be registered for any product or service you choose, as long as it doesn't conflict with an existing one for the same or similar product/service. Ie, in this case, you can't use Brown in the context of a transportation company, but if I were to call some new gizmoid that I just made "Brown" and market it thusly, I could tm/sm that contextual useage.
