It's not so much that UPS "owns" the sm/tm to "Brown", it's a contextual thing in terms of how they use it for business. Ie, in this case, you can't use Brown in the context of a transportation company, but if I were to call some new gizmoid that I just made "Brown" and market it thusly, I could tm/sm that contextual useage.
