In general that's ok.
Although it might be splitting hairs if the data they are accessing using 
custom written applications, or Query, are in files that originally came 
from the ERP vendor.  A case could be made that the design of the files 
came from them also.

What are you talking about?

No one using the ERP functions is going to be bypassing the ERP licensing.
Some users don't even need the ERP functions, they're using functions like 

Query/400 or in house written applications.
Why use an expensive ERP license just for the menuing when less expensive 
alternatives are available?

I have no idea if the open source option even meets our needs it's just an 

option, we're also looking at commercial menuing packages.
