Since the changes made a few years ago, yes.  OS/400 is now considered 
part of the hardware, and is sold with the 400 (this started around V4R1 I 
believe, and does not retroactively apply to the older hardware - another 
reason old CISC machines are not a good deal as you still need to buy 
OS/400 from IBM for them).
You can also buy or sell LPP's.  Not sure of the specific details as I 
haven't been involved directly, but presumably you would have to notify 
IBM of the sale as they would have to create license keys for the 
purchaser's 400.

As far as  I understand it the V4 software is  licensed to the CPU. SO....
