I do review the issues related to it so people who ask about it can make an informed decision. I think legally someone could be pursued for copyright violation, but it seems silly to do this. Also, there are a number of vendors who shipped compiled subsets of QUSRTOOL tools with their own products. That wasn't historically discouraged by IBM. Since we don't license subsets of the enhanced product it would be pretty mean of us to tell those vendors that they suddenly have to get all their customers to buy our software.
