Re: Licencing for BPCS source

Just to be clear... I'm not personally concerned for the company I work
for... more for the state of the enterprise software industry and its
customers in general....

With that said.... let me clarify a bit....

If they had a contract that allowed them to have the source and they made
modifications to the supplied source and have it in production... then the
contract runs out... and they sign a new contract that says.... you only
get objects now... they can't take back the source that was entitled
under the previous contract.... they just can't get new source and modify
it.... which sounds like what these guys are facing...

The courts have rarely shown sympathy to those who sign a contract. There

are those who have fought battles in the past with "I didn't think they
meant that" or "I thought it was a standard contract" or similar veins.
They routinely lose. You could try to get yourself declared mentally
incompetent but I don't think you want to go there. I really don't mean
that as a slam. Just to point out your options are limited. If you are
that concerned the time to talk to a lawyer is before you sign.
