Why does the precompiler not like this.
I can change it to a Select INTO, but was under the impression that SET was the preferred method.

Run the select interactively. What kind of error (or results) do you get?
Is it what you expect?
I'm assuming that it's because you will get a result set of more than one
record. Add "fetch first 1 rows only" after your having clause.

the MAX keyword?

Having Count(*) > 1;
