Is this correct? I have used this API successfully and I don't have the CONST keyword on the first parameter.

No, it's not correct. You should never have CONST on an output parameter. CONST should only be used when a field is input-only.
I don't know why I thought the parameter was input -- perhaps I was looking at the wrong API :)
