It is appropriate to use that descriptor when the conversation or complaint moves from the problem being discussed to a personal/negative/derogatory characterization of the vendor or of the vendor's staff. More directly ... someone noting that they disagree with the MS staff's characterization of this particular problem as benign is a properly civil (and very reasonable) complaint. Someone calling the MS staff unprofessional and incompetant is being a jerk. I make no specific assertions, anymore than Google is making assertions about others when it says that it's corporate motto is "Don't be evil."
