If you allow the Power7 to languish and never apply PTFs to it, nor upgrade it, then you do not need a contract for it, but I've never seen that scenario I proposed where the Power7 actually had useful workload (development/Test) not have PTFs applied to it. In that case yes you need SWMA.
If you apply PTFs, FSP updates etc. to a machine you need SWMA on it.

Jim,
The agreement that Paul showed seems to imply that this is not legal:
<snip>
Say you have two systems at your location. Power8, production: and Power7 development test. Both are at V7R2. If you only get SWMA on the Power8 and allow Power7 to go off contract.
</snip>
It seems to imply that you have to have both systems under SWMA since they are at the same site. Irregardless of whether or not you pinky promise to never put ptfs on the Power 7.

Yes if you intend to apply PTFs to it. And answering your earlier
question hardware and software maintenance can be purchased separately,
but usually they are bundled.
Say you have two systems at your location. Power8, production: and Power7
development test. Both are at V7R2. If you only get SWMA on the Power8
and allow Power7 to go off contract. You could use the Power8 to get PTFs
for that machine but it's against the licensing to apply those same PTFs
to the Power7. Furthermore you are stuck at V7R2 since you will not be
able to get software keys for V7R3 on the Power7.
At Power8 even the firmware needs a contract now. Tape libraries, tape
devices, HMC, Virtual HMC, etc. all need SWMA contracts to obtain
microcode updates and driver updates.

The above document does state the following and the italicized sentence
seems very clear about using support benefits that have not been paid in
full:
*3.8 IBM Software Subscription* and Support IBM provides IBM Software
Subscription and Support with each IBM Program licensed under the IPLA.
IBM Software Subscription and Support begins on the date of IBM Program
acquisition and ends on the last day of the corresponding month in the
following year, unless the date of acquisition is the first day of the
month, in which case coverage ends on the last day of the month, 12 months
from acquisition.
IBM Software Subscription and Support includes defect corrections,
restrictions, bypasses, and any new versions, releases, or updates IBM
makes generally available.
IBM provides Client assistance for Client’s
i) routine, short duration installation and usage (how-to) questions;
ii) coderelated questions (together “Support”).
Consult the IBM Software Support Handbook for details at
http://www.ibm.com/software/support .
Support for a particular version or release of an IBM Program is available
only until IBM withdraws Support for that IBM Program’s version or
release.
When Support is withdrawn, Client must upgrade to a supported version or
release of the IBM Program to continue to receive Support.
The IBM “Software Support Lifecycle” policy is available at
http://www.ibm.com/software/info/supportlifecycle/ .
If Client elects to continue IBM Software Subscription and Support for an
IBM Program at a designated Client Site, Client must maintain IBM Software
Subscription and Support for all uses and installations of the IBM Program
at that Site.
If Client requests to renew expiring IBM Software Subscription and Support
at a lesser quantity of IBM Program uses and installations than the
expiring quantity, Client must provide a report that verifies current IBM
Program usage and installation, and may be required to provide other
compliance verification information.
*Client shall not use IBM Software Subscription and Support benefits for
IBM Programs for which Client has not fully paid for IBM Software
Subscription and Support. If Client does, Client must acquire IBM Software
Subscription and Support reinstatement sufficient to cover all such
unauthorized use at then current IBM prices. *
Looks to me that we can't apply PTF's to a software stack that isn't
under "IBM Software Subscription and support".
Anyone know of any flaws in my deduction?
Really appreciate your feedback.

Do you know if there is a page on the IBM site that covers this aspect

licensing/entitlement?

Hi Guys & Girls,
I have a question around whether I am entitled to apply a Technology
Refresh and/or PTF’s without SWMA.
The target system was taken off SW Maintenance some time back and I
want to
know if I am legally entitled to apply PTF’s to this system.
Or do I have to re-enter into a SWMA to apply TR and or PTF’s to this
system.
I have another system that is fully Licensed with SWMA and am
entitled
to
download the IBM I V7.1 PTF’s and TR’s for this system – no problems
with
this system.
Look forward to your advice.
BTW: I have logged a query with IBM but waiting for their reply.
