RE: Reason not to go to V6R1

The tough one is when the vendor "forgets" to deliver the source code when
he provides updates. I have several clients with the same software provider.
During an ownership change, the software company decided to not make the
source code available at all. They told folks that they would make the mods
for the clients, and not give the clients the opportunity to get their own
programmers.

Now, the clients who pre-date the ownership change have to force the issue
and get the source code whenever an update is released. Big hassle,
especially if there is a change in the client's staff.

the problem with "escrowing" the source is that it will become the
property of a debt holder as a transfereable asset most likely at some
point in time during the liquidation procedings...and if you REALLY think
you're going to be able to get your hands on what you need WHEN you need
it.....

Nah, if I need source, get it up front and be done with it. Or find
another vendor. I've told more than one vendor nyet for refusing to
deliver current source.

You're right David. And, along this same note, some people ask vendors to
store ?indemnify? their source with a trusted third party. That way if
the vendor folds their doors in a real hurry there's at least someone who
can release the source.
This clause is something that needs to be considered in your contract when
you purchase the package.

I agree, Joe ... I really like WRKDBF and was disappointed when Bill
discontinued it without releasing the source or transferring it to
someone else who was willing to continue the work.

Of course this is one strong argument for open source code ... if the
original developer decides to stop maintaining the code, someone else
can take it over. Plus, since you have the source, recompiling it (when
necessary) for a new release is no problem.
