Ex: Once you become AWARE of a trademark infringement, if you do NOT defend your trademark by notifying the infringing party, you do not have a defensible trademark in court later... I've seen multiple references to this fact, and believe it would apply to copyright as well, but dunno. Not to contradict what you are saying, as I understand it Leif, which is that often the best lawyers win regardless of the what the law actually IS. And copyright/patent/etc. law is a hodge-podge, no doubt, at best...
