If I may:

ESS is only updated when new spins for the DVDs are created, and that is a
very intense and expensive task for IBM to accomplish, so it won't be done
very often.

Once you have downloaded the software from the ESS site, you have already
agreed to the terms/conditions of the software, that's why you need to go
there to get the first copy.

After you have agreed to the T/Cs then you can use the FTP site to get any
new versions/updates that might be put out. You only need to go to ESS
once. I suggest you do that, then go the FTP site and get the most recent
version there. Obviously use that copy.
