In the hypothetical sense, I've seen that work.  However, in my IBM service
area, we have a real PITA who keeps track of machines that he's seen before,
and refuses to fix them.

We actually worked out a deal where we paid the back maintenance, and he
still refused to fix it.  We talked to his supervisors, etc, and he still
refused to fix it.  We finally took it up to North Jersey, put in a service
call, and it was fixed.

It was unbelievable that no one could make this jerk fix the machine.

Generally IBM will verify that the machine is operational before they
accept it for maintenance. If it is not, then you pay to get it
operational, THEN they accept the contract.
