The kicker in the details of the Oracle guarantee seems to be item #6:

YOU WILL NEED TO PURCHASE THE PRODUCTS AND SERVICES RECOMMENDED BY ORACLE, AND
UNDERTAKE YOUR BEST EFFORTS TO OPTIMIZE YOUR WEBSITE IN ACCORDANCE WITH OUR
RECOMMENDATIONS.

I don't see any constraints on the size hardware they can recommend for the
replacement system; it doesn't appear to have to be comparably sized or priced,
and you get to pay full price for whatever they recommend.

I could deliver a 3 times performance boost to quite a few AS/400-based web
sites simply by upgrading them to an eserver iseries 400e model 840 (isn't that
what we're supposed to be calling it now?) and pocket a VERY hefty profit off
the upgrade fee in the process!

I've also dealt with customers, as I'm sure many of you have, who are looking
for a silver bullet solution that doesn't require any programming changes,
because they don't want to bear the expense of changing the code or the risk of
retesting it. Here again, an upfront requirement that *ALL* recommendations must
be accepted and implemented would make life as a consultant much less
challenging...

I guess I'm just a cynic sometimes...
