Does anyone know whether CGIDEV2 is open source?

AFAIK, IBM has never granted what might appropriately be called an open source license to CGIDEV2. At least, I've never seen an actual license. To the contrary, each user who downloads CGIDEV2 must accept IBM's terms, which include:

"IBM at all times retains ownership of the program/s or files and title to all code licensed or otherwise furnished to you."

To me, that brief statement means that users agree that IBM holds all intellectual property rights to CGIDEV2, including all rights to derivative works that you or anyone else may create.
