You can check the variable value while in debug to make sure. Also, here is the documentation for that API which states that the returned pointer can in fact be null: "For documents without a document type declaration this returns null reference object. The DOM Level 1 does not support editing the Document Type Declaration, therefore docType cannot be altered in any way."
