As I understand the situation ... SCO actually does own 'UNIX' ... they are claiming that Linux contains code originally from Unix (although they have yet to provide any actual proof).

That's my understanding as well. I chose my wording to acknowlege Novell's(? I think) counter-claim that added some mud to the waters. I haven't heard any resolution there yet and I'm pretty sure it wasn't tossed or dismissed as a nuisance suit.
