I question if a "simple" too-many-connections-cause-DOS would be accepted by Mitre. There are numerous machines (other than i) connected to the internet to serve content to users. If the machines can't cope with the sheer number of legit (and illegit) requests, you need more or bigger machines to handle these. From the patterns I learned in the past, there needs to be an exceptional impact on the server (such as crashing a task by memory overflows or the like).
