David,

Depending on what the customer did you may or may not have software. OS/400 IS included because that now goes with the system. However LPPs (i.e. WDS, Query, SQL, iSeries Access etc.) can be transferred to other systems. If they purchased a new i5-520 for example they may have transferred that software there meaning that even if you posses it, you don't really have it. If they are leaving iSeries or purchased a package machine that already included software then your copies can be made legal by transferring ownership to you.

 See Doug's post about that.

I recently purchased a used Model 170 from a customer that I'm planning on
using for a home play/learning box. It has V5R1 installed on it. V5R3
was shipped for this machine but was never upgrade..I was physically given
the upgrade software along with the box. What's the correct way of
transferring ownership on this thing? Is OS/400 included with the transfer
of ownership or am I suppose to start my own software maintenance agreement?
I'm not too worried about having support as the price was low and it is just
a play machine. Any suggestions would be appreciated. Thanks.
