Are you an American worker that is pi$$ed off about non-immigrant
high-tech workers coming here on H-1B visas to take American jobs?
Employers say that these workers are filling a need for skills not 
found in American high-tech workers.  

That is pure BULLSH*T rhetoric.  This is arbitrage.
For the most part, H-1B workers simply represent cheap labor.  

At this very moment our Benedict-Arnold Senators are trying to 
stealthily increase the number of H-1B's allowed in the country by 
tagging legislation to increase the number of H-1B's issued 
onto the omnibus spending bill that MUST be passed by 
Thursday or else the U.S. government will be in default on its debt.

I urge you to call or fax your Senator and Representative TODAY or 
TOMORROW to ask them to oppose this stealth legislation.

Don't send it to their local office, send it to Washington DC because
that's where they will be this week.

I had some encouraging news when I called Sen. Jon Kyl of Arizona. His
office told me that Kyl was opposed to putting any type of H-1B
increase on the omnibus spending bill.

Others are emailing me back with their experiences, so I thought I
would share some of their comments. Keep up the good work because we
are definitely making an impact in the Senate. They probably never
imagined that we could mobilize so many people to fight this increase.

We need to keep hammering them because the next couple of days is
crucial to stop this H-1B increase from being inserted into the
spending bill Make no mistake about one thing - the deck is not stacked
in our favor. We will only win this battle if massive numbers of people
call Congress to tell them that if they vote in favor of the H-1B
increase they will be held accountable for their betrayal of American
workers. 

Just to make sure this newsletter doesn't make you too happy and
therefore complacent, I have included a message for the Immigration
Lawyers Website newsletter. In their view, the increases are a done
deal. They are not in the best of moods because they want no limits on
the visa, and they clearly won't get that yet - but they hint of many
battles to come.

I will probably send another newsletter with the experiences from
activists. If you send me comments please indicate whether I can use
your name or not.

If you call a House or Senate office in Washington D.C., you might ask
to talk to an aid that is handling the omnibus spending bill. It's much
better to get past the receptionist that answers the call.

Congress has reconvened and is expected to pass the FY 2005 omnibus
bill appropriations package very soon. This omnibus bill will likely
contain provisions to provide relief for the H1B and H2B quotas. This
congressional action will surely be welcomed by many in the immigration
bar.

Unfortunately, the H-1B quota debate overlooks the actions of one
pivotal party: middlemen. More importantly, it ignores the speculation
engaged in by middlemen between US employers and H-1B professionals in
response to an artificial quota. This speculation exacerbates the ill
effects of an artificial quota (see today's Article for more).

For the last seven years, Congress has been dragged into the annual
ritual of the H-1B quota fight. We believe that Congress is getting
tired of this issue. The likely elimination of the H-1B cap for those
with advanced degrees can be understood as the first step in Congress's
plan to extricate itself from what has become a fruitless debate and
let market forces have a greater say in this part of immigration
policy. This augurs well for the sweeping immigration reform debate in
the months ahead.

I just called House Majority Whip Roy Blunt's washinton DC office.
Get this:  as soon as the receptionist heard that I was ranting against
the H-1B increase being attached to the Omnibus appropriations bill,
she shunted me to a voice mail box.  The outgoing announcement on the
voicemail box said "if you want to leave a message about the omnibus
appropriations bill and H-1B Visas please do so here". The bad news is
that I got dumped into voicemail.  The GREAT NEWS is that Blunt's
office has been slammed with so many anti-H-1B increase phone calls
that they had to create an entire new voicemail box for just this one
issue.

I was able to talk to 4 out of the 5 congressmans' aids this morning. 
Some of the aids were very nice and lent a "friendly ear" - they are
depicted by a triple asterisk "***" (The aids names are uppercased)

When I called my Senators and Reps, every office had a list already
going that was a Pro-Against H1B list. All I had to say was, do you
have a list going already Against H1B? Each said yes and I said,
GOOD,definitely put my husband and I on the AGAINST list! Each said
they did, taking our names and city.

Senate Majority Leader Bill Frist's aide routed me to a message system,
however Senate Majority Whip Mitch McConnell's aide was great. Make
those calls!
 
Also, on my own dime, I called Speaker of the House Dennis Hastert.
His aide tried to tell me to call my representative.  I told him I
already had, but he knew as well as I do that Mr. Hastert will have a
lot of say in what goes into the Omnibus Appropriations Bill.  That
shut him up -- and he said that he would pass my message to Hastert.

I have called all five of them and got through to Hastert's office and
gave/expressed my opinion.  Most will be answering around 8am CST (I
started 7:20am CS).  I will try again at 8am CST.  If calling
8am-4pm-ish 
is not possible, see if you can leave voice mail -- but talking to a
human is always preferable.

I talked to an aid to a Representative the House. He listened to my
concerns, and then said he is working with the Chief of Staff on this
issue.
