From http://www.rsasecurity.com/rsalabs/faq/6-3-1.html:

   RSA is patented under U.S. Patent 4,405,829...the patent expires
   17 years after issue...on September 20, 2000.

They're including DES in the base distribution because the export
restrictions have been relaxed by the U.S. government. Different crypto
issue.
