I would like to make this a more elegant solution perhaps amend the screen file to include and Unload *YES or *NO using some sort of if else condition in the CLP source not sure how best to achieve that though any thoughts guys.

When you go to the save menu and choose option 21, there's no point in providing options. One thought: Do a SNDPGMMSG MSGTYPE (*INQ) just before the unload command (chktap?) happens. Depending on the answer, processing within the CL either continues, or you can jump over the next steps (do..enddo around chktap and possible monmsgs) to leave the tape as is.
