Eric,

Provided that an employee does not use company resources the individual
owns it free and clear.  If you use your employers computer, office
supplies, phone or do it during the hours that you are paid, the
employer can lay claim to it.

Even salaried employees have working hours.  Sometimes looooong hours,
but they do have time of their own.
