I found this very annoying as well.
Since I want Snippets always to be available, we are automatically turning
on XML Developer capabilities in the next release.

Probably the same reasoning that says you have to have XML developer
capabilities enabled to be able to use snippets Joe! There doesn't
seem to be a lot of logic behind many of these type of decisions.
