This is true.  If you check the contract you signed originally with JBA, you
should find reference to a schedule which specifies minumum number of users
by AS/400 processor size.  When we upgraded our AS/400 from 500 to our 720,
JBA pointed out this vaguely worded clause.  We originally purchased a
license for 50 concurrent users and a 720 'requires' the licensee to
purchase a minimum number of users greater than 50 according to JBA's
schedule.  This was an unpleasant surprise to TMD which was never explained
during the sales cycle.  We asked our sales people repeatedly during the
sales cycle if JBA used tier-based pricing and they answered that everything
was user-based pricing.

I remember this issue from quite a while ago, (pre-black AS/400 days).  The 
customer implemented and found that the AS/400 was under powered for the 
additional interactive work load.  When planning an upgrade from and "E" to 
an "F" processor, JBA pointed out the language in the contract requirement 
payment to them.
