that works great... however there is one more caveat I can't figure out

to structure in to this statement...

I don't want any records where :clvl in ('4', '5) and :rvia = ' '

In your WHERE you can add:
and (not ( :clvl in ('4', '5) and :rvia = ' ' ) )

I think this is what you are looking for...
