Well...like Dennis says IANAL but...

It would seem to me that the mistake made was in not setting up
journalling during your testing of SSDs at the IBM lab. The question
is whose responsible? Honestly, I'd split the blame between whomever
is responsible for your system performance and IBM. Assuming you
don't contract out performance monitoring, then IMHO whoever handles
it in your company should have realized that journalling without
commitment control is a dog. :)

At the same time, the guys in the IBM lab should have certainly been
aware of it and shouldn't have let you test the SSDs without
journalling turned on.

If you paid some sort of fee for consulting services when you where
doing your SSD testing, then I'd think you've got a pretty good
argument for either returning the SSDs and buying the journal caching
option or getting the journal caching option gratis.

journal caching.  I have coworkers who believe that it should just be part
