Good question, John. Google groups has a forum for users and I did a search on "license" and "terms" and "agreement", and "availability" but didn't find a good answer. There were a number of questions that people had about Google's privacy policy, and data security.

My gut feel is that Google is offering the service to extend it's knowledge base about Web application use. And Google would lose goodwill if the service were disrupted. So there's motivation to keep it up.

I can see one's paranoia increasing as the value of data and an application goes up, so maybe the answer is to use Google charts for applications that can tolerate some risk to privacy and availability. Maybe limit use to data that you make available publically, if you're really paranoid.
