Faulty analogy. In your car analogy, the car would have to be sold with
the agreement that it not be (for instance) driven at greater than 55
mph and the EMS you've changed is running the car at a higher speed.
Then, the car manufacturer (who sells the same car at a higher price
with a license to go the higher speed) is trying to defeat your attempt
to circumvent your license with them.

In which case, you should actually be asking the "ethical, legal, could
you sue" question of both sides, since the buyer did make the purchase
agreeing to the license.

Do ethics only apply to the vendor?
