I spoke my piece with Best and IBM and the best they can offer is if I will pony up the $$ for a two or three year extended warranty they might can retro-warranty it. I pointed out that it was a known defect (I found a few old posts about this same problem) and technically it was broke the day I bought it. If I have to spend money it will not be on any product Best power makes.

 I agree w/ this sentiment.  Although, it is under IBM maintenance, so maybe they'll repair it w/o a fuss.

 Were you able to find "official" documentation that it's defective?
