Yes it is. It's called slander. He had worked for them before the job he has 
now... mine. When I first lost my job with the company he is now, he was the 
catalyst. He whined about the MIS manager day in day out till I got fed up and 
we collectively went to the boss to report him. I got tossed he stayed now 
this. Coincidence, I think not.

  I'll chime in here.  As a recruiter I am involved with reference/background 
  checks from time to time.

  If a client really wants to know about someone - I'll find my own source of 
  information.  Some times I'll call the references listed on the resume if 
  the client just wants to go through the motions.  Occasionally they will ask 
  me to do a little "extra" digging - detective work in a sense.  And for the 
  times I am hiring someone as a contractor - you can be I'll do my own 
  research beyond the minimum.

  Giving a bad reference is not illegal by the way as far as I know.
